Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner is a Medical Officer of Level- IV of the State of U.P. He is facing a departmental enquiry in which a charge sheet dated 20.08.2014 was served upon him. Pursuant to the said charge sheet the enquiry has been done and a report in that regard has been submitted on 13.02.2015 but no final decision has been taken.
The petitioner has preferred this writ petition for a direction to complete the disciplinary proceedings against him within a time bound period.
In view of the aforesaid facts and circumstances of the case, as the departmental enquiry was initiated on 20.08.2014 and the enquiry report has also been submitted on 13.02.2015, there appears to be no justification on the part of the disciplinary authority to keep the matter alive and not to conclude the departmental proceeding.
Accordingly, we dispose of the writ petition with the direction to the respondent no. 1 to complete the aforesaid departmental proceeding against the petitioner in accordance with law most expeditiously if possible within a period of three months.
The writ petition is disposed off.
