THIS CRIMINAL PETITION IS COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R When the matter is taken up for hearing, learned counsel for the petitioner files a memo seeking quashing of the proceedings against the petitioner in Crime No.226/2013 as the dispute between the petitioner and respondent No.2 has been settled. Affidavit to that effect is filed along with copies of the entire order sheet in DCP No.6076 in O.A.No.332/2009, copy of compromise application filed before the Debt Recovery Tribunal, Karnataka, Bangalore and copy of three Demand Drafts for having paid the amount of Rs.7,25,575/- to respondent No.2-Phoenix ARC Pvt. Ltd. under one Time Settlement Scheme.
2. Learned counsel for the respondents does not dispute the fact that the dispute between the petitioner and respondent No.2 has been compromised as reflected in the compromise petition filed before the Debt Recovery Tribunal, Karnataka, Bangalore.
3. In view of the settlement arrived at between the parties, nothing further survives for consideration in this petition. Accordingly, the peititon is disposed of in terms of the above memo. Proceedings against the petitioner in Crime No.226/2013 is quashed.
