Heard learned counsel for the petitioners and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 523 of 2009, under Sections 419, 420, 467, 468 IPC, police station Pura Kalandar, district Faizabad.
We have gone through the contents of FIR from which it comes out that some dispute has arisen between the complainant and the accused persons with respect to purchase of leaves of Stevia plant (a herbal plant used for medicines) of which this FIR is an outcome.
The FIR discloses commission of cognizable offence and cannot be quashed. However, considering the manner in which the FIR has been lodged and the allegations have been levelled, we hereby direct that the petitioners shall not be arrested in the aforesaid case crime number unless and until cogent and reliable evidence comes forward against them, provided they cooperate with the investigation, which shall go on.
With the aforesaid observations/directions, the writ petition is disposed of. Order Date :- 7.1.2010 Pradeep/-
