Heard Shri Umesh Chandra, learned senior counsel for the petitioner, learned standing counsel and perused the record.
Shri Umesh Chandra, learned senior counsel for the petitioner submits that Chief Pharmacist was in-charge of the Medical Store and the petitioner was not in-charge of the entire medical store, and no action has been taken against Chief Pharmacist .Further submission of learned senior counsel is that opposite parties are not justified in suspending the petitioner by impugned order dated 31.12.2010.
Accordingly, the Principal Secretary, Medical and Health, Civil Secretariat, Lucknow is directed to file para wise reply to the writ petition within one week from today.
Rejoinder affidavit, if any, may be filed with in three days.
