Heard learned counsel for the appellants and learned Standing Counsel for the respondents.
Counter affidavit may be filed within two weeks. Rejoinder affidavit may be filed within three weeks thereafter. List after expiry of the aforesaid period. The appellants have urged that they are teachers in the institution of respondent no.5 and the institution has taken in grant-in-aid list and the respondent-institution has filed a writ petition for getting Government Order dated 6.11.2006 withdrawn; so that the institution has become as a financial institution.
Prima facie, we are of the opinion that if the institution becomes as a financial institution then appellants are deprived of the benefits of aided institution which was conferred on the institution by the Government Order dated 6.11.2006. Therefore, the appellants are entitled for interim order. Until further orders of this court, the effect and operation of the order dated 16.12.2009 passed by learned Single Judge in Civil Misc. Writ Petition No.20312 of 2009 shall remain stayed.
