Heard Sri Radha Kant Ojha, Senior Advocate assisted by Sri Shivendu Ojha, learned counsel for the petitioner.
The petitioner was initially working as Lecturer in the Government Degree College, Dumariyaganj, district Siddharth Nagar. He had also applied for the post of Marketing Inspector for which he was selected. Thereafter, he has taken leave from the Government Degree College and joined on the post of Marketing Inspector on 01.01.2015. Now he wants to go back to his previous post of Lecturer in the Government Degree College.
The only prayer in the writ petition is for a direction to the respondent no. 1, Addl. Chief Secretary, Higher Education, U.P., Lucknow to decide the petitioner's representation dated 31.7.2018, annexure-11 to the writ petition.
No useful purpose would be served in keeping this writ petition pending.
The writ petition is, therefore, disposed of with the direction that if the petitioner prefers a fresh representation before the respondent no. 1, Addl. Chief Secretary, Higher Education, U.P., Lucknow within fifteen days from today in respect of his claim as raised in this petition along with a certified copy of this order, the respondent no. 1 shall consider and decide the same within a period of two months thereafter.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
