ORDER:
This writ petition is filed with the grievance that respondent No.3 has not given the petitioner proper opportunity of being heard in the claim petition filed by him.
At the hearing, respondent No.3 is personally present and he has narrated the events which led to reserving of orders in the claim petition on 28.10.2014.
Considering the fact that the petitioner is 88 years of age suffering from serious ailments, I am of the opinion that he deserves to be given a final opportunity to put forth his case.
The learned counsel for the petitioner submitted that he is ready to file the chief examination affidavit for being available for cross examination tomorrow itself. Sri A.H.Rama Krishna Rao, learned counsel for respondent No.4, submitted that he will cross examine the petitioner on 20.11.2014.
Accordingly, respondent No.3 is directed to re-open the claim petition, receive the affidavit evidence from the petitioner and permit respondent No.4 to cross examine the petitioner on 20.11.2014 at 3.00 pm. He is also directed to pass an appropriate order on the claim petition within one month.
Subject to the above direction, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.42942 of 2014 shall stand disposed of as infructuous.
