Present contempt application has been filed for punishing the opposite parties for willful disobedience of the order dated 8.7.2013 passed by this Court in Writ-A No. 31655 of 2013 (Om Prakash Verma vs. State of U.P. and others) by which the writ petition was disposed of with the following observation:
"Having heard counsel for the petitioner and for the State and on consideration of the above prayer of the petitioner, we dispose of the Writ Petition directing the respondents no.2 and 3 to conclude the said departmental proceedings, initiated against the petitioner in 1995 as early as possible, preferably within a period of six months from the date of communication of this order.
It is further directed that the petitioner shall co-operate with the above respondents in disposal of the departmental proceedings within the time allowed. Depending upon result of the departmental inquiry, the claim of the pension shall be considered and decided."
Learned counsel for the applicant states that the claim of the application's pension has not yet been considered the decided.
Sri Pankaj Saxena, learned standing counsel has produced a copy of the order dated 22.4.2014 issued by the Special Secretary on behalf of His Excellency the Governor of U.P. informing the Court that the disciplinary proceeding has been concluded without awarding any punishment to the petitioner/applicant, the order has been brought on record of the affidavit of compliance. He further states that all the formalities regarding payment of pension and post retiral benefits may be cleared off within a period of three weeks.
List this case on 26th May, 2014. In case pension and other post retiral benefits of the applicant are not paid to him before the date fixed in this case, the opposite parties shall remain present before the Court.
