HON’BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No. 1284 of 2012 ORDER:
This petition is filed to quash proceedings in C.C.No.600 of 2011 on the file of the VIII Metropolitan Magistrate, Cyberabad, Ranga Reddy District.
2. Initially, this Court granted stay on 02.02.2012 and directed the petitioner to take notice to the 2nd respondent by registered post with acknowledgment due. Learned counsel for the petitioner filed memo on 28.08.2012 along with returned cover. Thereafter, when the matter is listed in April, 2014, again on the request of learned counsel for the petitioner, personal notice is ordered to the 2nd respondent for both the addresses by registered post with acknowledgment due and directed to file proof of service within ten days. The matter is listed on 15.04.2014 and on the request of the learned counsel for petitioner it is adjourned by two weeks. It is again listed on 29.04.2014 and the learned counsel for petitioner requested time till Summer Vacation of 2014 and on the re-opening day the matter is listed and on the request of the learned counsel for petitioner it is again posted to this day. Today also request is made for further time. Though the petitioner is directed to take notice, no interest is evinced except taking time. When no material is produced to show that the order dated 02.04.2014 is complied with. I am not inclined to grant any further time.
3. Accordingly, criminal petition is dismissed for non- compliance of order. As a sequel, miscellaneous petitions, if any filed in this criminal petition, shall stand closed.
