ORDER:
This Writ Petition is filed for the following substantive relief:
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent Nos.2 and 3 in trying to interfere with the peaceful possession and enjoyment of the petitioner over lands bearing Sy.Nos.2, 3 & 48 admeasuring Ac.1-27 ½ guntas, Ac.4-25 ¾ guntas and Ac.4-16 guntas, total admeasuring Ac.10-29 ½ guntas situated at Seripur Village, Nizamabad Mandal, Nizamabad District, without following the procedure contemplated under law, is highly illegal, arbitrary, unjust, unconstitutional and in violation of principles of natural justice and also in violation of Articles 14, 21 and 300-A of Constitution of India, and consequently, to direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner over the subject property without following the procedure contemplated under law.”
It is represented by learned counsel for both parties that this Court has disposed of Writ Petition No.24578 of 2014 by order, dated 08.10.2014 and that the issues raised in this Writ Petition are identical to that raised in the said Writ Petition.
In the light of the above submissions, the Writ Petition is disposed of in terms of order, dated 08.10.2014, in Writ Petition No.24578 of 2014 with the direction that the directions and observations made therein shall form part of this order.
As a sequel to disposal of the Writ Petition, interim order, dated 27.08.2014, is vacated and W.P.M.P.No.30809 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
