This Criminal Petition is filed to quash Proceedings in CC.No. 37 of 2012 on the file of Judicial Magistrate of First Class, Amalapuram, East Godavari district.
2. Heard both sides.
3. The main grievance of the petitioners is that they are falsely implicated due to political reasons and though the FIR disclose that about fifty T.D.P. activists attacked the bus and caused damage. Charge Sheet is filed only against these three petitioners and there is no specific overt act against these petitioners.
4. On the other hand, learned Public Prosecutor submitted that the matter is posted to 28/7/2014 for appearance of the petitioners/accused before trial court and they can urge these grounds during trial.
5. Considering the submissions of both sides and the facts of the case, I feel that this criminal petition can be disposed of, directing the court below to proceed with trial and dispose of CC.No. 37 of 2012 as expeditiously as possible by fixing some time schedule and also by dispensing with the presence of petitioners for each and every adjournment.
6. For the above reasons, trial court is directed to conduct trial and dispose of CC.No.37 of 2012 as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order and the presence of petitioners is dispensed with for each and every adjournment. However, they shall appear as and when trial court feels that their physical presence is necessary for any particular adjournment for identity purpose or any other specific purpose.
