Under order of writ Court dated 13.09.2017 the respondents were required to consider the request of the petitioner who happens to be Additional Chief Medical Officer, Mainpuri for voluntary retirement from service.
An affidavit of compliance has been filed. Along with the said affidavit the communication sent by the Government dated 25.09.2017 to the Director General, Medical and Health Services, U.P. Lucknow, mentioning that it would not be possible to accord approval to the request of the petitioner for voluntary retirement, has been annexed. The communication states that it would not be in public interest to permit the petitioner to retire voluntarily before attaining the age of superannuation.
Since a decision in due compliance of the order of the writ Court has already been taken, therefore, this Court is not inclined to proceed any further in the matter.
The contempt application is consigned to record.
