Heard Sri Ashok Khare, learned Senior Advocate assisted by Sri Siddharth Khare, learned counsel for the petitioners, learned Standing Counsel representing respondents no. 1,2 and 3 and by Sri A.K.S. Parihar, learned counsel appearing for respondent no. 4.
The petitioners claim that they had applied pursuant to advertisement No. 1 of 2011 dated 07.06.2011 for selection of Principal in an aided Intermediate Colleges in 2011. But till date selections have not been completed in view of the interim order granted on 03.02.2014 in writ petition no. 6550 of 2014 with regard to declaration of result. The said stay order was vacated on 28.11.2018 and it was provided that result etc. be declared but the same shall be subject to final decision of writ petition.
The petitioners are aggrieved by an order dated 09.07.2019 by which certain queries have been made by the Government with regard to the selection process etc. and number of vacancies in order to regularize the Ad-hoc Principal working in the institution. Similar information has been sought by an order dated 11.97.2019 by Director, Secondary Education.
Learned counsel for the petitioners submits that as per queries made by the Government if all the existing Ad-hoc Principal in Intermediate colleges are regularized then the entire selection held by the Selection Board for appointment of regular Principals and rights of hundreds of applicants will get frustrated.
It is to be noted that the petitioners' apprehension is based on inter departmental communication which in any case is not any formal decision on the issue. Such inter departmental communication can not have any impact on the rights of the existing officiating Principal in the institution.
I am of the view, that this writ petition at this juncture is premature and does not call for any further consideration.
With the above observation, this writ petition is dismissed.
