Heard Shri Arun Kumar Gupta, learned counsel for the petitioner and Shri Ved Byas Mishra, learned counsel for respondents.
Learned counsel for the petitioner has narrated the facts from the year 1997 till date on the basis of the averments made in the petition.
Without going into the details, the relevant facts which are necessary to dispose of this petition are as follows :-
The petitioner was appointed as part time Lecturer in Hindi for academic session to academic session in the respondent - University. The petitioner worked on the strength of interim orders, granted by this court in various writ petitions. Orders are dated 15.2.2000 passed in Writ Petition No.8002 of 2000 and dated 2.9.2004 whereby bunch of writ petitions were decided along with the petition filed by the petitioner. The relevant part of order dated 2.9.2004 is quoted hereinafter :-
Most of the petitioners had an interim order allowing them to continue as lecturers on honorarium basis till regularly selected candidate is available and joins.
It is obvious that teaching work in the education institutions has to be continued for which the teachers are essential.
Therefore, we direct that till the decision of the Supreme Court is given and implemented, the same arrangement as made by the interim orders will continue in respect of all such petitioners of this bunch of writ petitions who had such interim order in their favour.
With the aforesaid observations, the bunch of writ petitions is disposed of.
The petitioner has also approached this Court by way of filing Civil Misc. Writ Petition No.44211 of 2000, which was disposed of, vide order dated 17.10.2000 with the direction to consider the application of the petitioner. The petitioner, got another interim order dated 10.2.2004 passed in Writ Petition No.4964 of 2014. Finally, he filed a representation, dated 22.9.2014 to the Chancellor of the Sampurnanand Sanskrit Vishwa Vidyalaya, Varanasi. Probably, this representation has been considered at different level of the University and there are some communication between the concerned officials.
Learned counsel has relied upon certain noting which are on record in order to show that the matter is still pending and likely to be placed before the Executive Council of the University.
Learned counsel for the respondent - University submits that the petitioner has worked only till 1997 and the entire salary has been paid to her for the work she has done and he submits that no vacancy exists in the concerned department of the University.
Considered the submission and without going into the merits of the case, at this stage, respondent nos.1 and 2 are directed to take appropriate decision, in case, any issue is pending in regard to the petitioner. In case, the decision has already been taken, the same may be communicated to the petitioner. In case, the matter is still pending, the appropriate authority may pass an order, in accordance with law, within a period of eight weeks from the date of production of a certified copy of this order before the respondent no.2.
With the aforesaid observations, the petition is disposed of.
