By means of this writ petition, the petitioner is seeking benefit of the Government Orders that have been enclosed as Annexures 6 and 7 to the writ petition, both dated 1 August 2014 which provide for granting of regular scale of pay, arrears of salary and consequential benefit to the doctors from the date of their ad hoc appointment.
In this regard, it has been pointed out that by means of a letter dated 6 April 2015 that has been enclosed as Annexure-10 to the writ petition, the Chief Medical Officer, Ghazipur has communicated to the Deputy Director, Medical Health that apart from the petitioner and doctors mentioned in the letter, some other doctors who were appointed in the years 1990, 1991 and 1992 on ad hoc basis have been granted regular pay-scale and consequential benefits. For claiming this benefit, the petitioner has moved a representation dated 4 April 2015 (Annexure-8 to the writ petition) which has been received in the office of the Chief Medical Officer, Ghazipur on the same day.
No useful purpose would be served in keeping the writ petition pending.
We, therefore, direct that the Principal Secretary, Medical Health and Family Welfare, Lucknow i.e. respondent no.1 shall take a decision on the representation filed by the petitioner within a period of three months from the date of receipt of a certified copy of this order along with a copy of the representation dated 4 April 2015.
With the aforesaid observation, the writ petition is disposed of.
