Heard learned counsel for the parties and perused the record.
The dispute with regard to payment of higher pay scale of Rs. 1500-2500 w.e.f. 1.1.1973 is pending. The petitioner has been informed that the decision with regard to higher pay scale shall be taken by opposite party no. 4. However, it has been stated by the learned counsel appearing for the university that the controversy shall be settled by the State Government.
Being the disputed question of fact and keeping in view the age of the petitioner as 72 years, it would be appropriate that an early decision is taken in the matter.
Accordingly, we dispose of the writ petition finally directing the Principal Secretary, Agriculture, Education & Research, U.P. Lucknow to look into the matter and take a decision with regard to higher pay scale to the petitioner w.e.f. 1.1.73 in accordance with law, by passing a speaking and reasoned order within a period of two months from the date of production of certified copy of this order. The decision so taken shall be communicated to the petitioner. Vice Chancellor and the officers of the University shall do necessary exercise with due communication to the principal secretary concerned, so that the decision may be taken within the aforesaid period.
Subject to above, the writ petition stands disposed of. No order as to costs.
