Heard learned counsel for the petitioner and learned Standing Counsel, who represents all the respondents.
With the consent of learned counsel for the parties, the writ petition is disposed of .
The petitioner was appointed as Medical Officer (Community Health) on 18.06.1988 on ad-hoc basis in the State Ayurvedic and Unani Medical Services Cadre and therefore, the petitioner joined on the aforesaid post on 05.07.1988 at the office of Chief Medical Officer, Jaunpur. The petitioner, therefore, continued his services and retired from the services on 31.07.2018. It is not disputed that the services of the petitioner was regularised with effect from 21.01.1991.
The submission of learned counsel for the petitioner is that till date that is after expiry of more than 14 months from his retirement the pensionery benefits are not given to the petitioner nor the monthly pension of the petitioner is fixed.
In this regard, the petitioner has approached the respondent no.3 as well as respondent no.4 by way of representations dated 01.04.2019.
Learned counsel for the petitioner has placed a copy of the letter issued by the opposite party no.5 addressed to the opposite party no.3 by which the opposite party no.5 have sought the clarification from the opposite party no.3 related to the claim of the petitioner's pensionary benefit.
Learned counsel for the petitioner submits that on account of non-disposal of the letter issued by the opposite party no.5 addressed to the opposite party no.3, the pension and retirement benefits are not finalised.
Having heard the learned counsel for the parties, this writ petition is disposed of by directing the respondent no.3 to consider the petitioner's representation dated 01.04.2019, a copy of which is enclosed as Annexure 7 to the writ petition and to dispose of the letter issued by the Chief Medical Officer, Chandauli dated 5th March, 2019 (annexure-6 to the writ petition) by passing a speaking and reasoned order, strictly in accordance with law, preferably within a period of two months from the date of presentation of certified copy of this order.
With the above observation, the writ petition is disposed of.
