Heard Sri Utkarsha Birla, learned counsel for the petitioner and the learned standing counsel who appears for the State respondents.
Learned counsel for the petitioner has pointed out the order passed by this Court earlier dated 4.10.2018.
Learned standing counsel has produced a copy of the instructions dated 10.10.2018 before this Court sent by the under Secretary to the Government of U.P..
In the instructions, it has come out that the petitioner's case is similar to that of Dr. Ram Niwas Tyagi & others.
It has also been said in the instructions that decision taken by the Government in pursuance of the judgment of this Court in Dr. Ram Niwas Tyagi dated 3.5.2018 shall also apply to the petitioner.
In view of the instructions so received, the writ petition is disposed of with a direction to the respondent to grant the benefit of the judgment rendered in Dr. Ram Niwas Tyagi also to the petitioner.
The instructions are kept on record.
