Heard learned counsel for the petitioner and learned A.G.A. for the State.
The present writ petition has been filed for quashing the order dated 16.03.2010 passed by learned Chief Judicial Magistrate, District Gautambudh Nagar in Case No. 6482 of 2007, under Sections 409, 420, 467, 468, 471, 120-B I.P.C., Police Station Sector 20, Noida, District Gautambudh Nagar, whereby discharge application filed by the petitioner has been rejected as well as for quashing the order dated 26.04.2010 passed by learned Sessions Judge, District Gautambudh Nagar whereby revision against the aforesaid order has been also dismissed.
It is contended by learned counsel for the petitioner that the matter ispurely of civil nature and no offence under the charged Sections is made out against the petitioner, who is the retired Doctor.
As prayed by learned counsel for the petitioner, put up this case as fresh before appropriate court on 23rd July, 2010.
Till the next date, no coercive action shall be taken against the petitioner in the aforesaid case.
