No.35286 of 2016) ..Respondents Prayer: Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the respondents to enrol the petitioner and to undergo Compulsory Rotatory Residential Internship (CRRI) in any approved Medical College-Hospital in the State of Tamil Nadu and subsequently, issue permanent registration certificate on successful completion of CRRI.

Raman, Standing Counsel for R2 O R D E R This writ petition is filed for issue of a Writ of Mandamus directing the respondents to enrol the petitioner and to undergo Compulsory Rotatory Residential Internship (CRRI) in any approved Medical College-Hospital in the State of Tamil Nadu and subsequently, issue permanent registration certificate on successful completion of CRRI.

The case of the petitioner is that after obtaining eligibility certificate from the Medical Council of India on 05.04.2003 to do his undergraduation in Medical Course in a Foreign Medical Institution, he pursued his Bachelorette in Medicine in the International University of Health Sciences, Saint Christopher & Nevis for the academic year 2002-2003 and passed MBBS in November, 2008. Thereafter, the petitioner had also successfully cleared the eligibility examination conducted by the Medical Council of India in June, 2016. Thereafter, the petitioner applied for issuance of provisional registration certificate with the 1st respondent, pursuant to the orders passed by the High Court of Kerala in W.P. NO. (Civil) 23676/2011. However, the same was returned without any endorsement. Subsequently, a circular was issued by the Medical Council of India, directing all State Medical Councils in India to process the application for grant of provisional/permanent registration to all such candidates, who have obtained their degree from the International University of Health Sciences, Saint Christopher & Nevis, covered by the judgment of Honourable High Court of Kerala. Based on the said circular, the petitioner again submitted a representation dated 29.09.2016 to the 1st respondent to issue him with Provisional Registration Certificate so as to enable him to undergo the Compulsory Rotatory Residential Internship (CRRI), in any approved Hospital in the State of Tamil Nadu. Since his request was not considered, the petitioner has come before this Court.
3. Heard the parties and perused the records.
4. Mr.G. Sankaran, learned counsel for the 1st respondent would submit that the petitioner has complied with all the formalities and therefore, necessary orders will be passed within a period of one week.
5. In view of the undertaking given by the learned counsel for the 1st respondent, no positive orders need be passed in the present writ petition.
6. Recording the undertaking given by the learned counsel for the 1st respondent, the writ petition is disposed of . No costs.
