SRINIVAS COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 482 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to modify the order passed in Crl.MP.No.661 of 2014 in Crime No.18 of 2014 on the file of the Court of the Special Sessions Judge-cum-IV Additional District and Sessions Judge, Guntur, dated 02-04-2014.
The Court made the following Order:
“The petitioner was granted anticipatory bail by the learned Special Sessions Judge-cum-IV Additional Sessions Judge, Guntur. While granting anticipatory bail, the learned Sessions Judge recorded that the petitioner shall be released on execution of bond of Rs.20,000/- (Rupees twenty thousand only) with two sureties in a like sum to the satisfaction of the Special Mobile Court, Guntur, in connection with Crime NO.18 of 2014 on certain conditions. The learned counsel for the petitioner submitted that the learned Special Mobile Court, Guntur, is not accepting the surrender of the petitioner on the ground that the learned Sessions Judge did not specifically direct the petitioner to surrender and did not direct the learned Mobile Court, Guntur to receive such surrender.
In view of circumstances stated above, this petition is allowed. The order is modified directing the petitioner, who is A.1 to surrender before the learned Judicial Magistrate of First Class, Special Mobile Court, Guntur, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Special Mobile Court shall enlarge the petitioner on execution of a bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties in a like sum to his satisfaction subject to the conditions envisaged in Para – 5 of the order of the learned Special Sessions Judge–cum-IV Additional Sessions Judge, Guntur, in Crl.M.P. No.661 of 2014.”
