The petitioner before this Court was one of the applicant for the post of Lecturer in Kaumarbhritya/Bal Roga as per advertisement No.01/2009-2010 made Banaras Hindu University, Varanasi (hereinafter referred to as BHU). The petitioner participated on the process of selection. However, he submits that after interview, he obtained knowledge that in the subject persons who participated in the selection were not expert for which qua the post in question. He further submits that the constitution of the selection committee was not in accordance with statute 27 of the first Statutes of the BHU and, therefore, the entire selections are vitiated. The Court has further being informed that the meeting of the Executive Council of the BHU is scheduled to take place on 24.6.2010 and in case the objections raised are not considered by the Executive Council illegal appointments would result.
In the facts and circumstances, we are of the considered opinion that interest of justice would be met if the petitioner is permitted to file his objections in respect of the selection committee by 12 noon tomorrow before the Vice Chancellor of BHU. The Vice Chancellor shall place the objection of the petitioner along with recommendation of the selection committee for the post before the Executive Council which is scheduled to meet on 24.06.2010 at 2.00 P.M. The Executive Council of BHU is requested to consider the objection raised by the petitioner in respect of the constitution of the selection committee and take appropriate decision on its recommendations in accordance with law thereafter.
The writ petition stands disposed of.
