THIS CIVIL PETITION COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R The marriage of the petitioner and the respondent was solemnized on 30.08.2009 at Bengaluru. The marriage did not sail well. Due to differences between the parties, the respondent has filed M.C.No.526/2017 on the file of I Additional Principal Judge, Family Court, Mysuru against the petitioner for dissolution of marriage on the ground of cruelty.
2. The petitioner has filed M.C.No.2825/2018 against the respondent before the Principal Judge, Family Court, Bengaluru for restitution of conjugal rights. She is seeking transfer of M.C.No.526/2017 from the Family Court, Mysuru to the Family Court, Bengaluru on her medical grounds and the ground of her hardship of traveling to Mysuru etc.
3. Learned Counsel for the respondent submits that he has no objections to transfer the petition as prayed for.
4. Having regard to the submission of the learned Counsel for the respondent and considering facts and circumstances of the case, it is just and expedient to withdraw and transfer the case as prayed for.
Therefore, the petition is allowed. M.C.No.526/2017 on the file of I Additional Principal Judge, Family Court, Mysuru is hereby withdrawn and transferred to the Court of Principal Judge, Family Court, Bengaluru for disposal along with M.C.No.2825/2018 pending before the same Court in accordance with law.
