The case of the petitioner is that he was allotted a plot of land. Pursuant to which, he deposited Rs.10,20,001/- with the authority and a lease deed was executed on 03.07.2010. At the time of delivering possession, it was found that an area from the allotted plot has been utilized by the authority (the lessor) for construction of a road. Consequently, the petitioner applied to the authority for allotment of another plot and to execute a revised deed of lease.
As no action was taken on petitioner's request, this petition has been filed for a direction upon the second and third respondents to consider the claim of the petitioner and execute revised lease deed as also deliver possession of the plot.
Sri A.B. Singhal, who appears for the respondents 2 and 3, states that the process of allotment/execution of revised lease is on and would be completed shortly.
The learned counsel for the petitioner submits that this petition may be disposed off by requiring the respondents 2 and 3 to complete the process within a specified period of time.
Considering the facts and circumstances of the case, we deem it appropriate to dispose off this petition by requiring the respondents 2 and 3 to complete the process in respect of fresh allotment/revision of lease, expeditiously, preferably, within a period of three months from today, subject to fulfilment of all the necessary formalities by the petitioner.
The petition stands disposed off.
