1. Sri Atul Kumar Singh holding brief of Sri S.D. Dwivedi, counsel for petitioner states that he has no instructions in the matter. No other counsel has appeared on b ehalf of petitioners though the case is called in revise.
2. By means of present writ petition, petitioners has sought following reliefs:
(i) Issue a writ, order or direction in the nature of certiorari to quash the impugned order dated 8.9.2014 passed by respondent no. 3 in pursuance to order dated 4.9.2014 passed by respondent no. 2.
(ii) Issue a writ, order or direction in the nature of Mandamus directing the respondents not to evict the petitioner from allotted house no. 3, Type-3, Officers Colony/ DM Compound, Shahjahanpur without adopting due procedure as prescribed to evict the tenant from rented accomodation.
3. We ourselves have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting relief as prayed for.
4. Morever, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
