1. It is contended that petitioner is entitled to be considered for regularization in the light of Full Bench judgment of this Court in Service Bench No. 1639 of 2015 (Dr. Sunita Sharma Vs. State of U.P. and another), decided on 26.10.2017 and in this regard he has also made a representation dated 29.03.2018 to respondent concerned but the same has not been examined at all.
2. Learned Standing Counsel appearing for respondents stated that in case matter has not been decided, Competent Authority shall look into the same and decide representation expeditiously.
3. In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally directing respondent no. 1 to consider claim of petitioner for regularization on the post of Medical Officer in the light of Full Bench judgment in Service Bench No. 1639 of 2015 (supra) as well as earlier judgments of this court referred to therein, i.e., judgment dated 09.07.2014 passed in Writ Petition No. 26637 of 2012 (Dr. Dhirendra Prakash Tiwari Vs. State of U.P. and others), whereagainst Special Leave Petition was also dismissed by Supreme Court vide judgment dated 27.03.2015, and pass a reasoned order within a period of one month from the date of production of a certified copy of this order alongwith copy of aforesaid representation.
