Heard Sri Ashok Khare, Senior Counsel assisted by Sri Siddharth Khare, learned counsel for the petitioner and Sri K.R. Singh Jadaun, learned counsel for respondent University.
The petitioner has come up in the writ petition for the following relief:-
"(a) A writ, order or direction in the nature of certiorari quashing the notification dated 14.10.2019 issued by the respondent University (Annexure No.4).
(b) A writ, order or direction of a suitable nature commanding the respondents not to interfere in the functioning of the petitioner as Head of the Department of Dance, Faculty of Performing Arts, Banaras Hindu University in pursuance to the notification dated 11.10.2019 (Annexre No.3)."
Learned counsel for the respondents submits that the petitioner has been appointed as Head of the Department of Dance, Faculty of Performing Arts in Banaras Hindu University and thus, the grievance of the petitioner in the present writ petition is satisfied and no cause of action survives.
Learned Senior Counsel submits that he does not dispute the aforesaid fact, however, he submits that a warning has been issued to the petitioner by the Joint Registrar, Banaras Hindu University on 22.11.2019 against which she may be permitted to pursue the remedy available in law.
The writ petition is dismissed with the aforesaid liberty.
