Sri. T.P. Rajendra Kumar Sungay, Advocate for R2 & R3) Writ Petition No.52488/2014 is filed under Articles 226 and 227 of the Constitution of India praying to quash or set aside the Government Order dated 18.06.2014 passed by the R1 at Annexure – J and etc., These writ petitions coming on for Orders this day, the Court made the following:
ORDER R. DEVDAS J., (ORAL):
The petitioner is assailing the Government Order dated 18.06.2014 whereunder the Government, in exercise of the powers conferred under Section 10 (1) of the Karnataka State Universities’ Act, 2000, has annulled the proceedings of the Syndicate of Mysore University with respect to the recruitment made in violation of norms during 2006 and 2007 and the appointment issued thereunder.
2. The learned counsel for the petitioner submits that similar petitions were filed by many appointees the very same order was questioned. One such petition in W.P.No.59874/2014 was disposed of on 06.07.2018, setting aside the impugned order dated 18.06.2014 and the same has been produced by the learned counsel for respondents–University by way of a memo dated 02.01.2019. Therefore, the learned counsel for the petitioner submits that this petition may be disposed of on similar terms.
3. In that view of the matter, as ordered in W.P.No.59874/2014, while keeping open all the contentions to enable the petitioner to urge before the Government, the impugned order dated 18.06.2014 is set aside. Liberty is granted to the respondent – Government to proceed afresh after providing an opportunity to the petitioner.
4. In terms of the observation made in the W.P.No.59874/2014, these petitioners are accordingly disposed of.
