RESPONDENT THIS CIVIL REVISION PETITION IS FILED UNDER SECTION 18 OF THE KARNATAKA SMALL CAUSES COURT ACT 1964 AGAINST THE JUDGMENT AND DECREE DATED 24.09.2019 PASSED IN SC NO. 1694/2018 ON THE FILE OF THE I ADDL.SMALL CAUSES JUDGE, DECREEING THE SUIT FOR EJECTMENT.
THIS CIVIL REVISION PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER This revision petition is filed challenging the judgment dated 24.09.2019 passed in S.C. No.1694/2018 on the file of the I Additional Judge, Court of Small Causes, Bangalore wherein the petitioner herein was directed to quit, vacate and handover the vacant possession of the suit schedule premises to the plaintiff within one month from the date of the order.
2. Today, learned counsel for the petitioner files an affidavit undertaking to vacate and handover the vacant possession of the suit schedule premises on or before 31.12.2020. Further, the petitioner undertakes to pay monthly rent of Rs.10,000/- per month from 01.01.2020 till vacating the schedule premises.
3. The affidavit undertaking in placed on record.
4. Learned counsel for the respondent/landlord has no objection for the same. Further the learned counsel for the respondent/landlord would state that the respondent/landlord would refund the security deposit of Rs.1,00,000/- to the petitioner after deducting any arrears of rent or expenses, if any.
6. The revision petition is disposed of, in terms of the affidavit undertaking. The Petitioner is directed to vacate and handover vacant possession of the schedule premises on or before 31-12-2020 and to pay a sum of Rs.10,000/- p.m towards rent/damages till handing over possession.
