This petition has been filed with the grievance that certain conditions imposed by the respondents in their 'Sarv Shiksha Abhiyan' Scheme, on account of which petitioner has been transferred, is arbitrary. A direction has been sought from this Court to require the competent authority to revisit the issue.
It appears that petitioner had challenged his transfer but the writ petition itself was dismissed. The order passed in Writ Petition has been affirmed with dismissal of Special Appeal (Def.) No. 488 of 2018. It is, thereafter, that the petitioner has filed the present writ petition. This Court finds substance in the objection raised by Sri Amit Shukla, learned counsel for the respondent that the ground urged in the petition was available to him when he had filed earlier writ petition and having not raised it then a second writ petition would not lie, particularly when the cause remains the same.
In such view of the matter this petition is not entertained and is dismissed, accordingly.
