Heard Shri Sankalp Narain, learned counsel for the petitioner and learned Standing Counsel for the State respondent nos.1 to 6.
Dr. Brij Bhushan Bansal is before this Court with request to issue direction commanding the respondents to consider his case for extension of his services in terms of the Government order dated 30.12.2014.
Learned counsel for the petitioner submits that the petitioner is presently working as Principal of Sanatan Dharam Inter College, Meerut and is going to retire on 31.3.2018. He is also a State Awardee for his excellent service. The State Government has issued a Government order on 6.5.1982, wherein it was provided that all those teachers including Principal, who are State awardee or National awardee, will get the extension of two years in service. Thereafter, the State Government again issued an order on 30.12.2014 for providing extension upto 65 years to the teachers, who received the State or President award. In pursuance of the aforesaid Government orders, the petitioner applied for his extension of service. On 17.1.2018, the Additional Director of Education (Secondary) has already referred the case of the petitioner to the Chief Secretary, Government of UP, Lucknow to take appropriate decision. The request has been made to issue direction to the first respondent to decide the claim of the petitioner for extension of service in the light of recommendation so made by the Additional Director of Education (Secondary) dated 17.1.2018.
Learned Standing Counsel appearing for the State respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the first respondent, Principal Secretary (Secondary Education) Government of UP, Lucknow to decide the claim of the petitioner for extension of his service in the light of the aforesaid Government orders and the recommendation so made by the Additional Director of Education (Secondary) dated 17.1.2018 within a period of two months from the date of production of a certified copy of this order before him.
