Heard learned counsel for the petitioner, learned Standing Counsel for respondents no.1, Sri Dhananjay Awasthi, respondent no.2, Sri Avneesh Tripathi, learned counsel for respondent no.3 & 4 and Sri Vinod Kumar Singh, learned counsel for the respondent no.5.
The petitioner in the present writ petition has assailed the order dated 28.08.2019 passed by the Vice Chancellor, Chaudhary Charan Singh University, Meerut whereby the petitioner has been removed from service.
A preliminary objection with regard to maintainability of the writ petition has been raised by the learned counsel for the University contending that against the order impugned there is statutory alternative remedy of Reference under Section 68 of the State Universities Act.
Since the petitioner has statutory alternative remedy, the writ petition is dismissed on the ground of alternative remedy.
