High Court Of Judicature at Allahabad|26 April, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 11239 of 2013 Petitioner :- Dr.Aslam Khan Respondent :- Union Of India Thru Its Secy & Ors.
Counsel for Petitioner :- Vipin Sinha,Devesh Singh,Shagun K. Saran,Shailly Saxena,Syed Khursheed Anwar Alvi Counsel for Respondent :- A.S.G.I.,S.C.,S.S.Singh
Hon'ble Sudhir Agarwal,J. Hon'ble Ifaqat Ali Khan,J.
1. Called in revise. None appeared for the petitioner to press the writ petition. However, Shri Tirath Ram Shukla holding brief of Shri Shasank Shekhar Singh, learned counsel for respondent is present. In the circumstances, we ourselves have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(i) issue appropriate writ, order or direction in the nature of writ certiorari quashing the impugned termination order dated 25th July, 2012 (Annexure-A to the writ petition) resolution/decision of the Executive Council dated 9th February, 2013 (Annexure-B to the writ petition) and the petitioner be reinstated with all consequential benefits.
(ii) issue appropriate writ, order or direction in the nature of writ restraining the respondent authorities from acting in pursuance of the advertisement dated 12th September, 2012 (Annexure-C to the writ petition) for appointment of Assistant Professors in Law Economic and Political Science.
(iii) issue appropriate writ, order or direction directing the respondent authorities that the services of the petitioner may also be extended as is being done in the case of other 9 members."
3. We ourselves have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting relief as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
