JUDGMENT / ORDER

Sri Anil Kumar Tewari, learned Senior Advocate, assisted by Sri Paavan Awsthi, holding brief of Sri Apporva Tewari, learned counsel for the petitioner submitted that no order has been passed by the respondents with-holding the regular pension and gratuity of the petitioner in exercise of powers under Regulation 919 (A) of Civil Services Regulations. He further submitted that similarly situated persons, the name of whom has been given in the rejoinder affidavit, have been granted the benefit of A.C.P. and 3/4th of subsistence allowance and based on that the provisional pension is being paid to them which has been denied to the petitioner while the allegations are similar.
Sri D. C. Pathak, learned Additional C.S.C. prays for and is granted ten days time to seek instructions and file specific reply to the rejoinder affidavit.
