By the order dated 30.7.2009, notice was directed to be issued to the respondent nos. 4 and 6.
Shri S.F.A. Naqvi, learned counsel for the petitioner states that copies of counter affidavits on behalf of the respondent nos. 4 and 6 have been received in his Office. While the counter affidavit filed on behalf of the respondent no. 4 is on record, no counter affidavit on behalf of the respondent no.6 is on record. Office is directed to trace the same, and place it on record.
Rejoinder affidavits have been filed today on behalf of the petitioner in reply to the counter affidavits filed respectively on behalf of the respondent nos. 2,4 and 6.
An application being Civil Misc. Application No. Nil of 2009 has been filed today on behalf of the petitioner.
Registry is directed to give appropriate number to the said application.
It is, interalia, prayed in the said application that fresh notice be issued to respondent no.5 at the address as mentioned in the prayer clause of the said application.
Let the said address be incorporated in the writ petition in respect of the respondent no.5. Necessary amendment will be made during the course of the day.
Notice will be issued to respondent no.5 at the aforementioned new address given in the aforesaid application. Notice will be issued fixing 22.2.2010. Requisite steps will be taken within a week.
