Petitioner has made an application for her transfer from Sukhdev Inter College, Khaga, District Fatenhpur to Pandit Jawahar Lal Nehru Inter College, Bhoopatpur Sahso, District Prayagraj. It is alleged that the resolution has been passed by the respective committee of management of both the institutions and the District Inspector of School has also forwarded such claim of transfer to the Additional Director of Education to be considered in accordance with Regulations-55 to 61 of Chapter-III framed under the U.P. Intermediate Education Act, 1921. Grievance is that though the matter has been referred in the year 2016 itself but a final decision has not been taken by the Additional Director so far.
Learned Standing Counsel submits that an appropriate decision in the matter would be taken by the competent authority, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon respondent no.3 to accord consideration to petitioner's claim of transfer, in accordance with law, by passing a reasoned order, within a period of two months from the date of presentation of certified copy of this order.
