Heard learned counsel for the parties.
Petitioner retired on attaining the age of superannuation. By the instant writ petition, petitioner seeks following relief:
"to issue a writ, order or direction in the nature of mandamus directing the respondent authorities to release Rs.6 Lacs in the account of gratuity payment immediately, wrongly withheld by the respondent authorities and further be pleased to direct not to recover any amount in pursuance of the letter dated 18.01.2014 (Annexure No.4 to the writ petition)."
Learned Standing Counsel submits that the second respondent- The Director, Ayurvedic Services, U.P., Lucknow, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the second respondent-The Director, Ayurvedic Services, U.P., Lucknow, to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of three months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
