This writ petition has been filed, inter alia, for the following relief:
(I) Issue writ, order or direction in the nature of mandamus directing the respondents to decide the second appeal dated 12.11.2018 filed by the petitioner which is pending before the appellate authority under section 19(3) of the Right to Information Act (Annexure No.11 to the writ petition).
Learned counsel for the petitioner has confined his prayer to the extent that the respondent no. 3- Chief Information Commission Office of Principle Secretary (Medical Health & Family Welfare), U.P. at Lucknow may be directed to decide the second appeal dated 12.11.2018 of the petitioner within the stipulated period .
Heard learned counsel for the petitioner, learned Standing counsel appearing on behalf of the State and perused the record.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the respondent no. 3- Chief Information Commission Office of Principle Secretary (Medical Health & Family Welfare), U.P. at Lucknow to decide the second appeal dated 12.11.2018 in accordance with law expeditiously after hearing the concerned parties.
