Dr.M.S.Latha ..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari to call for the records pertaining to the impugned order dated 12.04.2011 passed in M.P.No.2 of 2011 in S.H.R.C.No.3547 of 2010 on the file of the State Human Rights Commission and quash the same.
For Petitioner : Mr.C.Jayavel For Mr.Babu Rangasamy For 1st Respondent : Mr.Anbumani For 2nd Respondent : Mr.R.Asaithambi O R D E R [Order of the Court was made by M.VENUGOPAL, J.] The Learned Counsel for the 2nd Respondent has filed a Memo dated 22.08.2017 before this Court on 11.09.2017 that as against the Proceedings of the Human Rights Commission in S.H.R. Case No.3547 of 2010, the 2nd Respondent now does not want to proceed with the case and she undertakes to withdraw the case which is pending before the 1st Respondent/State Human Rights Commission, Chennai.
2. Pursuant to the aforesaid Memo, the Learned Counsel for the 2nd Respondent has made an endorsement with reference to the contents of the Memo in W.P.No.12575 of 2011.
3. Added further, the Learned Counsel for the Petitioner, in view of the undertaking given by the 2nd Respondent through Memo dated 22.08.2017 before this Court as stated supra, he is withdrawing the present Writ Petition and also not pressing with the case.
4. Recording the aforesaid facts and the endorsements so made, the Writ Petition is dismissed as withdrawn. It is abundantly made quite clear that the 1st Respondent/Tamil Nadu State Human Rights Commission shall permit the 2nd Respondent/Complainant to withdraw the case in S.H.R. Case No.3547 of 2010 filed by her within a period of two weeks from the date of receipt of copy of this order. No costs.
