Heard learned counsel for the petitioner.
The present writ petition has been filed against the order dated 22.5.2018 passed by the Deputy Director of Consolidation, Aligarh, i.e., respondent No. 1 (hereinafter referred to as, 'D.D.C.').
The grievance of the petitioner is that the order was passed without giving any opportunity of hearing to him and further the order amounts to a review.
There is a laches of almost more than a year in fling the writ petition and the laches have not been explained in the writ petition. However, in the interest of justice and because the grievance of the petitioner is that the order dated 22.5.2018 has been passed by the D.D.C. without giving the petitioner any opportunity of hearing and without issue any notice to him and because the order affects the chaks allotted to the petitioner, it is directed that in case the petitioner files a recall application before the Deputy Director of Consolidation, Aligarh, i.e., respondent No. 1 bringing all the necessary facts to his notice within one month from today, the same shall be decided by the Deputy Director of Consolidation, Aligarh within three months thereafter.
It is clarified that the Court has not adjudicated either on the merits of the claim of the petitioner or on the correctness of the averments made by the petitioner that the impugned order has been passed by the D.D.C. without affording any opportunity of hearing to the petitioner which shall be decided by the D.D.C. after considering the records of the case.
With the aforesaid direction, the writ petition is disposed of.
