Chandrasen Reddy COUNSEL FOR THE RESPONDENT : The Public Prosecutor Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and grounds filed herein, the High Court may be pleased to direct the Station House Officer, Tenali-III Town Police Station, Guntur District to release the petitioner/Accused No. 1on bail in relation to FIR No. 164 of 2012 on the file of the SHO Tenali –III Town Police Station, Guntur District, in the event of the petitioner’s arrest.
THE COURT MADE THE FOLLOWING ORDER “The petitioner is A1. He seeks for grant of anticipatory bail. He allegedly committed offences under Section 498-A and 354 IPC. It is contended by learned counsel for the petitioner that the petitioner and his former wife had entered into a settlement outside the court and the petitioner not only paid Rs.5.00 lakhs to his wife but also had taken a bond in the name of minor child. Apart from the fact of the alleged settlement, in view of the nature of the offences levelled against the petitioner, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Accordingly, this Petition is allowed. The petitioner shall surrender before the I Additional Junior Civil Judge, Tenali, within two weeks from today. On such surrender, the learned I Additional Junior Civil Judge, Tenali, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.”
