Heard learned counsel for the petitioners, learned Standing Counsel for the State and perused the record.
The present petition has been filed for a suitable direction to the learned Civil Judge (J.D.), Gorakhpur to decide the application 47-C of the petitioners under Order 1 Rule 10 with Section 151 C.P.C. in original suit no. 1036 of 2013 (Pateshwar & others Vs. Govind and others), as expeditiously as possible.
No useful purpose would be served in keeping the present petition pending, which is finally disposed of with a direction to learned Civil Judge (J.D.), Gorakhpur to decide the application 47-C of the petitioners under Order 1 Rule 10 with Section 151 C.P.C. in original suit no. 1036 of 2013 (Pateshwar & others Vs. Govind and others), most expeditiously, preferably within six months from the date of receiving of certified copy of this order, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case, the proceedings of the aforesaid case, is not stayed by any Court.
With the above observations and directions, writ petition stands disposed of.
