JUDGMENT / ORDER

Hon'ble Manish Mathur,J.
Heard learned counsel for the petitioner, learned Chief Standing Counsel accepted notice on behalf of opposite party no.1 as well as Mr. Amarjeet Singh Rakhra, learned counsel appearing for opposite parties no.2 and 3 and perused the records.
The instant writ petition has been filed seeking following reliefs:
"(I.) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to provide the domestic electric connection to the petitioner in the urban area, as he has completed the entire formalities regarding the electric connection.
(IIi) Issue a writ, order or direction in any nature which this Hon'ble Court may deem fit and proper under the circumstances of the case.
(Iv) award the cost of the writ petition in favour of the petitioner."
Mr. Amarjeet Singh Rakhra, learned counsel appearing for opposite parties no.2 and 3 submits that there is a case of electricity theft on the premises in question, pending against the son of the petitioner where provisional assessment was made in which the demand of Rs.10,00,000/-(Ten lakh) approximately was raised. The petitioner has not disclosed as to whether the said assessment was finalized and whether his son has filed any appeal against the final assessment order.
It is submitted that in the given circumstances, petitioner is not entitled to get any fresh electricity connection on the premises in question. It is also submitted that in case petitioner is aggrieved due to denial of fresh electricity connection on the premises in question he may raise his grievance before the Consumer Grievance Redressal Forum Constituted under Section 42 sub-Section 5 of the Electricity Act, 2003.
In this view of the matter, the writ petition is finally disposed of with liberty to petitioner to approach the aforesaid Forum by raising his grievance. In case the petitioner approaches the said Forum, it is needless to observe that the said Forum will consider the grievance of petitioner and do the needful in accordance with law expeditiously.
