JUDGMENT / ORDER

Donkenur Mallamma W/o. D. Ganapathi . Petitioner/Accused No. 2 in Crime No.149 of 2014 on the file of K.P.H.B. Police Station, Ranga Reddy District.
AND The State of Andhra Pradesh, Through P.S. K.P.H.B., Ranga Reddy District, Rep. by its Public Prosecutor, High Court Buildings, High Court of A.P., Hyderabad.

Petition under Sections 437 & 439 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in Crime No. 149 of 2014 on the file of the P.S., K.P.H.B., Ranga Reddy District on such terms and conditions.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri Kaluvala Venkata Vara Prasad, Advocate for the Petitioner and of the Public Prosecutor on behalf of respondent-State, the Court made the following ORDER:-
“The petitioner is A2. She seeks for grant of bail. She allegedly committed offence under Section 304-B IPC. The petitioner is the mother of A1. It is the case of the prosecution that the petitioner along with her son caused dowry death of the deceased. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences levelled against her.
The petitioner filed successive bail application before the Sessions Court and unsuccessful. The learned counsel for the petitioner submitted that A-1, who is the main accused, had already been enlarged on bail. The petitioner is a lady. While granting bail to A-1, the learned Sessions Judge recorded that the investigation more or less has concluded. At any rate as many as 16 witnesses had already been examined by the investigating agency.
In view of the nature of the offences levelled against the petitioner, in view of the sex of the petitioner and in view of the stage of the investigation, I consider it appropriate to enlarge the petitioner on bail.

Consequently, this Petition is allowed. The petitioner/A2 is enlarged on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to the satisfaction of learned XIX Metropolitan Magistrate, Cyberabad, at Kukatpally, at Miyapur.”
