JUDGMENT:
This second appeal is filed against the judgment and decree, dated 01.05.2014, in A.S.No.35 of 2011, on the file of the learned IV Additional District Judge, Ranga Reddy District at L.B.Nagar, whereby the learned Judge has confirmed the judgment and decree, dated 21.12.2010, in O.S.No.66 of 2004, on the file of the learned Junior Civil Judge, Ibrahimpatnam, Ranga Reddy District.
This case was argued by the learned counsel for both the parties at length.
At the hearing, on the initiative of this Court, the parties agreed for compromising the dispute. The appellant has filed A.S.M.P.No.1689 of 2014, whereby he has stated that both the parties have entered into a joint memo of compromise. Along with the application, the joint memo of compromise has been filed, a perusal of which shows that the same is signed by both the parties as well as their respective counsel. As per the compromise, the respondent agreed to receive a sum of Rs.8,00,000/- towards the full and final settlement of her claim and the appellant has handed over cheque bearing No.745769, dated 28.11.2014, drawn on State Bank of Hyderabad, Ibrahimpatnam for the said sum. The respondent has agreed for allowing the appeal in furtherance of the compromise entered into between the parties. Besides the joint memo of compromise, the appellant has filed his personal affidavit, wherein he has sworn by the terms of compromise.
In the light of the above facts, ASMP No.1689 of 2014 is ordered and the second appeal is accordingly allowed. The Registry shall incorporate the terms of compromise in the decree.
As a sequel to disposal of the second appeal, S.A.M.P.No.1170 of 2014 shall stand dismissed as infructuous.
