Heard Sri Anoop Kumar, learned counsel appearing for the review-applicant and the learned State Counsel.
This review petition/application seeks review of the judgment and order dated 02.02.2016 whereby the writ petition filed by the review-applicant, namely, Writ Petition No. 2150(Ceiling) of 2016 was dismissed.
This Court while passing the judgment and order dated 02.02.2016 has observed that the limitation as provided under Section 27(6) of the U.P. Imposition of Ceiling on Land Holdings Act will have no application in this case for the reason that the proceedings were initiated on the basis of the report of Additional Collector dated 31.08.1995 and that it was well within the limitation. The Court has further observed that subsequent report submitted on 17.04.2009 was furnished after cognizance in the proceeding for cancellation of pattas was taken and during pendency of the said proceeding.
Learned counsel for the review-applicant has made an attempt to re-argue the matter which, in my considered opinion, would not be permissible under the review jurisdiction. The review proceeding cannot be converted into the proceeding of appeal in disguise.
I, thus, do not see any reason/ground to entertain this review petition/application, which is hereby rejected.
