Heard learned counsel for the petitioner; learned Standing Counsel for the respondent no.1; and Sri A.K. Yadav has for the respondent nos.2 and 3.
The case of the petitioner is that she has been issued letter of appointment dated 08.09.2016 by District Basic Education Officer, Mathura thereby appointing her as Assistant Teacher, Gaushala Karnawal, Mathura. It has been submitted that prior to her appointment at Primary School, Gaushala Karnawal, Mathura the petitioner was appointed as Assistant Teacher in Primary School by way of adjustment from the post of Shiksha Mitra. According to the circular issued by the Basic Shiksha Parishad, for her present appointment, she is required to submit a No Objection Certificate from her previous employer within a period of one month from the date of her present appointment.
The grievance of the petitioner is that she has applied for No Objection Certificate to the respondent no.3 but no order has been passed on the said application. It is thus the prayer of the learned counsel for the petitioner that a direction be issued to the respondent no.3 to take a decision on the application of the petitioner for grant of No Objection Certificate.
Considering the nature of the prayer made by the petitioner, without expressing any opinion on the merits of the claim of the petitioner, this writ petition is disposed of with a direction upon the third respondent (District Basic Education Officer, Mathura) to take a decision on the application of the petitioner for No Objection Certificate to join her current post, pursuant to the appointment letter dated 08.09.2016, preferably, within a period of 10 days from the date of filing of certified copy of this order in his office along with copy of previous application moved in that regard.
