Learned advocate for the petitioner has tendered Draft Amendment of August-2012 today and requested that the petitioner may be permitted to amend the petition so as to add paragraph No.5.1 in the petition and to place on record documents annexed to the draft amendment.
Ms. Patel, learned advocate for the respondent no.2, has submitted that without admitting the contents and without prejudice to her rights to file appropriate reply in light of the amendment, she has no objection if the request, as prayed for, is granted.
In view of aforesaid aspects, the draft amendment is granted.
The petitioner is permitted to amend the petition in terms of the draft amendment.
The amendment to be carried out on or before 29.12.2012.
Mr. Nanavati, learned Senior Counsel for the petitioner, has requested for some time. Ms. Patel, learned advocate for the respondent no.2, has opposed the request for adjournment. However, considering the fact that learned Senior Counsel for the petitioner is engaged in part-heard hearing of another matter, time is granted.
