Heard learned advocate for the parties. It appears that application Exh. 47 for bringing heirs of deceased defendant No. 1 on record was decided on the ground that copy of the application was not supplied. Hence the matter requires consideration. Hence Rule.

Learned advocate Mr. Shah for respondent Nos. 1/1 and 1/2 is at liberty to raise all the contentions available under law including maintainability of the petition at the time of final hearing.
