Argument is that petitioner was transferred from Mirzapur to Gobraha, Varanasi by order dated 14.07.2014, pursuant to which she joined at Varanasi on 31.7.2014 (Page 37 of the writ petition) but by an ante dated order dated 15.7.2014 transfer of petitioner to Varanasi has been modified for Badlapur Jaunpur.
Submission is that petitioner got her joining at Varanasi and got herself settled with the children and there appears to be no reason or justification for passing of the ante dated order which is clear in view of her joining dated 31.07.2014.
It is further submitted that in place of the petitioner at Varanasi nobody has been transferred/placed,and therefore she is entitled to get protection.
Learned Standing Counsel is to obtain instruction and apprise this court the correct/complete fact.
Let this matter be posted, as fresh, on 17.09.2014.
As an interim measure, this court directs that till the next date of listing operation of the order dated 15.07.2014 shall remain stayed and if the petitioner is still working at Gobraha Varanasi then she will not be disturbed.
